Media Usage & Licensing

Effective Date: April 12, 2026

This Media Usage & Licensing Agreement (“Agreement”) governs the use of all photos, videos, and media content created by The Fulness of Real Estate Media (“Company,” “we,” “us,” or “our”).

By booking or using our services, you (“Client”) agree to the following terms.

1. Ownership of Media

All media produced by The Fulness of Real Estate Media remains the sole intellectual property of the Company.

No ownership rights are transferred to the Client unless explicitly agreed to in writing.

2. License Grant (Standard Listing Use)

Upon full payment, the Client is granted a limited, non-exclusive, non-transferable license to use the media solely for marketing the specific property or project for which the media was created.

This license is intended for real estate listing promotion only.

3. Permitted Uses

Under the standard license, the Client may use the media for:

  • MLS listings

  • Real estate platforms (e.g., Zillow, Realtor.com)

  • Social media marketing

  • Agent or brokerage websites related to the listing

  • Print marketing materials directly tied to the property

4. Restrictions on Use

The following uses are strictly prohibited without prior written consent and an extended license:

  • Use by third parties (including builders, stagers, designers, or other agents)

  • Use for branding, advertising, or promotional campaigns unrelated to the specific listing

  • Transfer, resale, or sublicensing of the media

  • Significant alteration, editing, or application of filters that change the original work

  • Use of media after the property has been sold, withdrawn, or expired

5. Extended Licensing

Any use beyond the standard listing license requires an Extended License, which may include:

  • Builder or developer marketing

  • Portfolio or long-term brand use

  • Paid advertising campaigns

  • Multi-property or ongoing usage

Extended licensing is subject to additional fees and must be agreed upon in writing prior to use.

6. Re-Listing & Continued Use

If a property is re-listed, transferred to another agent, or marketed again after expiration, a new license or re-listing feemay be required.

Use of media beyond the original listing period without renewal is considered unauthorized use.

7. Third-Party Use

Media may not be shared with or used by third parties without written permission from The Fulness of Real Estate Media.

Third parties must obtain their own license to use the media.

8. Portfolio & Marketing Rights

The Company reserves the right to use all media for:

  • Portfolio display

  • Website and social media promotion

  • Marketing, advertising, and business development

If a Client requires media to remain private or confidential, this must be agreed upon in writing prior to the shoot and may be subject to additional fees.

9. Unauthorized Usage & Penalties

Any use of media outside the scope of the granted license constitutes unauthorized use and a violation of copyright law.

Unauthorized use includes, but is not limited to:

  • Use of media by third parties without permission

  • Continued use after a listing has sold, expired, or been withdrawn without renewal

  • Use of media for commercial purposes (e.g., builder marketing, advertisements, or branding) without an extended license

  • Alteration, resale, or redistribution of media without written consent

In the event of unauthorized use, The Fulness of Real Estate Media reserves the right to:

  • Invoice the user for retroactive licensing fees at a rate of up to three (3) times the standard licensing fee

  • Require immediate removal of the media from all platforms

  • Pursue legal action for copyright infringement, including recovery of damages, legal fees, and associated costs

Failure to comply with removal or payment requests may result in further legal enforcement.

10. Credit & Attribution (Optional but Appreciated)

While not required, crediting The Fulness of Real Estate Media when sharing media is appreciated and helps support our business.

11. Agreement Acceptance

By using our services, the Client acknowledges and agrees to all terms outlined in this Media Usage & Licensing Agreement.
